Investerare i Madoff feeder-fond begär status som ’kunder’ i domstol

Stockholm ( www.HedgeFonder.nu ) – Investerare i 16 fonder som kanaliserat in pengar i Bernard L. Madoff’s bedrägeriupplägg har bett en domstol att döma att de var ”kunder” hos Madoff och därmed berättigade till pengar som avsatts för de som drabbats.

Bloomberg rapporterar i en artikel att investerare i en inlaga den 14 oktober till US District Judge Denise Cote i New York, begär att domstolen upphäver ett avgörande i konkursdomstolen som förhindrar dem från att göra anspråk på en del av de 8,7 miljarder USD som återvunnits hittills av Madoff’s konkursförvaltare Irving H. Picard. USAs Konkursdomare Burton Lifland ansåg dem som oberättigade i ett beslut i juni, eftersom de inte hade konton direkt med Madoff’s firma, Bernard L. Madoff Investment Securities LLC (BLMIS).

Investerarna säger att de placerade sina pengar i fonder som investerade 95% eller mer hos Madoff’s firma. Lifland höll med Picard i hans beslut att neka deras fordringar.

“Konkursdomstolen ignorerar helt enkelt att ’Feeder-fonderna’ skapades specifikt, och med en rättslig skyldighet, att investera sina investerares pengar på BLMIS konton uttryckligen för att dra nytta av Bernard Madoff’s under lång tid till synes framgångsrika förvaltning och investeringsstrategi”, sade investerarna i korthet, enligt Bloomberg.
