Ansvariga bakom Weavering Capital skyldiga till bedrägerier

Stockholm (HedgeFonder.nu) – Grundaren Magnus Peterson och styrelseledamöter i den kraschade hedgefonden Weavering Capital har dömts att betala 450 miljoner USD – motsvarande ca 3,2 miljarder SEK – efter att ha befunnits skyldiga till bedrägerier under månaderna som ledde fram till tidpunkten då fonden slutgiltigt kollapsade. Det rapporterar The Telegraph.

Beslutet kommer endast månader efter att brittiska Serious Fraud Office (SFO) lade ner en parallell undersökning av företaget. Advokater som representerar investerare i fonden säger att de nu kommer begära att SFO öppna undersökningen på nytt gentemot Magnus Peterson.

De åtalade inklusive Magnus Peterson, grundare av Weavering, befanns skyldiga till att ha manipulerat siffror och vilselett investerarna i den London-baserade fonden.

Som The Telegraph skriver så konstaterar även en amerikansk domare, som hanterar ett civilrättsligt mål gentemot Magnus Peterson, att hans förklaringar till vad som gick fel ”inte är trovärdiga”.

Domare Proudman säger: “Jag accepterar inte Petersons påståenden om att investerarna förstod hans strategi mycket väl vid tidpunkten. Han kan inte visa något dokument där han förklarar den. Under alla omständigheter är det min åsikt att dessa swap-instrument aldrig vara ämnade att vara verkställbara instrument.”

Nyckelanklagelserna som gjorts gentemot Magnus Peterson och övriga svarande, inklusive hans fru Amanda Peterson, Chas Dabhia och Edward Platt, var att företaget ingick “skentransaktioner” som påstods vara baserade på ”ränte-swappar”.

Affären på 637 miljoner USD gjordes med ett offshore-bolag kopplat till Peterson. Weavering kollapsade kort efter att affären avslöjades i mars 2009.
