Varnar för krasch bland UCITS-hedgefonder

Stockholm (HedgeFonder.nu) – En artikel i Financial Times i veckan rapporterade att vissa personer inom branschen tror att vi inom de närmaste två åren kommer att få se någon hedgefond inom UCITS III-regelverket försvinna på grund av att förvaltare pressar de regulatoriska gränserna. Med nya fonder som lanseras varje vecka kämpar tillsynsmyndigheterna för att hålla jämna steg med fonderna i sin granskning av hur förvaltarna följer sina strategier enligt tillstånden. Oroliga röster har höjts sedan en tid tillbaka, där vissa kommentatorer tror att alltför många förvaltare trycker in sina fonder i UCITS-skalet med skohorn för att kompensera för den mängd inlösen av fondandelar som uppkommit i spåren av den globala finanskrisen. En chef på en amerikanska investmentbank säger till Financial Times att de “är absolut säkra på att blir en smäll i någon fond under de kommande två åren”, och tillade att det är “en katastrof som bara väntar på att hända”. Som exempel tvingades BlueCrest Capital att ta bort sin UCITS-fond från BAML s MLIS fondplattform som en följd av oro över problem med tracking error. Europeiska kontrollmyndigheten European Securities and Markets Association (ESMA) tros för närvarande se över vilka instrument som används i de nya fonderna inom UCITS-regelverket. Även om de säger att dagens regelverk utgör betydande garantier till icke-professionella investerare, tittade de även närmare på användningen av komplexa strategier. “Mot bakgrund av denna information kommer vi att överväga huruvida ytterligare åtgärder måste vidtas,” sade de.
